Specific session

Senate President Hofschneider pointed out during the session that distinctive counsel Joe McDoulett was retained by his office environment to aid with the impeachment procedures.

For the general public comment period of the session, Hofschneider stated that five minutes would be allotted per individual for general public remarks.

Democrat Rep. Leila Staffler was the very first to just take the podium, questioning McDoulett’s position as “special counsel,” and opposing the proposed Senate impeachment guidelines.

“When I appeared at the procedures, I will not lie, I was stunned at the lengthy technique, that at any given level prior to the genuine Senate impeachment demo proceedings could disqualify the copious quantities of proof that exhibit obvious and repetitive actions of felony, corruption, and neglect of duty by Governor Torres in excess of these various many years. Without the need of the evidence to back it up, the impeachment procedure is incomplete,” she claimed.

“Doing what is right is in no way easy, but it is generally the right detail to do. So, senators, we talk to that you do what is right for the people: to be fair. These principles? They are not honest. They skew in favor of this impeached governor.”

Democrat Rep. Corina Magofna then stepped up to the podium to also provide her comments.

“If the Senate body moves ahead and adopts the impeachment principles as it is, then you will be encroaching and overreaching into the Dwelling of Representatives’ abilities to prosecute the situation that’s prior to us. Basic and straightforward,” she explained.

After the general public comment period of time, the senators mentioned the proposed impeachment rules.

Senator Santos explained for the impeachment demo of former Gov. Benigno Fitial in 2013, the senators “understood that their constitutional mandate was to carry out a fair and neutral hearing, and not to challenge the sufficiency or dismiss the Home articles of impeachment.”

Fitial resigned right before the Senate could conduct a demo.

Santos questioned the Senate impeachment principles for the trial of Torres.

“Mr. President, I do not recognize why the committee chooses to dictate who must provide as the impeachment prosecutor,” she stated.

Santos pointed out that in the U.S. Congress, the impeachment managers are selected by the Household speaker.

As for the rule to limit the impeachment prosecutor to just the Property legal counsel and team, Santos claimed this is “unjust, unethical, unfair, and unreasonable” to the Dwelling of Associates.

“If these overreaching actions ended up reciprocated, I undeniably question that the Senate would consent and tolerate these kinds of disregard [for] the separation of the houses of Legislature, and this has been echoed by many associates of the Home of Associates,” she included.

She also mentioned that there ended up no constraints put on who the impeached official can have as authorized counsel and staff members for the impeachment proceedings.

“Again, this is very biased, partial, and unfair to the Household of Reps… I am not a legal professional, but centered on my being familiar with of the proposed rules, the Senate will not be conducting a good and neutral trial and, if these regulations are adopted, we may not even have a trial at all. The proposed regulations are littered with bias. It’s exceptionally apparent and clear that the scales of justice have been intentionally tipped to accommodate the impeached,” she reported.

In accordance to Sen. Deleon Guerrero, “It is distinct that the adopted impeachment regulations do not spell justice.”

Senator Manglona similarly opposed the impeachment procedures.

Voting in favor of adopting the guidelines were the Senate president, the Senate ground chief, Hocog, Cruz and King-Nabors.

These opposed ended up Deleon Guerrero, Manglona and Santos.

On Jan. 12, 2022, by a vote of 15 to 4 with 1 abstention, the Democrat-Unbiased-led Property impeached the Republican governor for commission of felonies, corruption, and neglect of obligation. He has denied the allegations.

He will be eradicated from business if 6 members of the Republican-led Senate vote for his conviction.
